Terms and Conditions

  1. These Terms and Conditions (“T&C”), as amended from time to time are the complete and exclusive statements of understanding between Agilo Research Pvt Ltd (“AR”) & the Participant/Users (through Parent/Legal guardian/School) and to participate in Codeavour (hereinafter referred to as the “Competition”). It supersedes all other prior understandings, whether oral or written. All representation or other communications between the AR & the Participant amounts to acceptance of these terms & conditions.
  2. AR shall provide an online platform for enrolling in the competition to the Users/Participants. All registration and payment procedures shall be in accordance with the terms and conditions herein, as may be amended from time to time and/or any other communication as shared by AR from time to time.
  3. Important Dates:

    5. Results Declaration: To be declared
  4. By participating in the Competition, a Participant unconditionally and irrevocably accepts and agrees to be bound by all these terms and conditions as stated herein.
  5. AR shall not be responsible for any entering the Competition unlawfully or otherwise in breach of any applicable laws.
  6. AR reserves the right, in its sole and absolute discretion, to terminate or disqualify any Participant’s participation in the Competition or reclaim the prize at any time if it is the opinion of AR that there has been a breach of any of the Terms by such Participant (whether discovered during or after the end of the Competition).
  7. All the contents and material of the Competition is an Intellectual Property of AR and the User/Participant shall have no right over the same.
  8. Any commercial use of the Competition is strictly prohibited and shall be punishable under applicable laws.
  9. There is a total of 3 different age groups in which you can participate:
    • Elementary: 7 – 10yrs Old
    • Junior: 11 – 14yrs Old 
    • Senior: 15 – 18 yrs Old
      The birth dates have been defined with respect to the date of commencement of the competition.
      Note that you will be competing against participants only in your age group.
  10. Team Registration Process (Registrations may be done by Individual Users or groups of 2 Participants):
    1. User shall visit: https://codeavour.org/register/ 
    2. The user shall create a team account either for himself/herself or for the prospective Participant.
    3. Users will sign up with personal details such as Name, Email id, Contact Number, School Details, or any other details as may be required.
    4. Post successful registration, the User/Participant will be directed to the payment page where payment can be made using a debit/credit card, net banking, UPI, digital wallets, etc.
    5. All Participants will have to create a separate account with a unique “Team Name” and “Password” which they can use throughout the Competition.
    6. Once the payment has been realized by AR, access to the learning portal shall be granted to the Participant.
    7. Access to the Program through the Account of the Participant shall be granted post registration.
    8. The registration Fee for each Participant for the entire Program is available on the website HERE.
    9. The students’ data will be shared with the partner organization to coordinate with the participants in regional and national events and to share their achievements with the respective schools.
    10. AR reserves the right to disqualify Participants for misrepresenting
  11. You can participate in a team, the team size would be 1-3 students per team + one mentor.
  12. It is mandatory to submit the following things to participate in this online AI, coding, and robotics competition. Each of them carries marks that will be used to crown the winner:
    • Project Description: You need to enter a textual description of your project in 200 words.
    • Project File: You need to paste the PictoBlox project’s link.
    • Project Video: You need to create a video of 5 to 10 min. duration covering the following things:
      • Brief about you and your teammate.
      • Brief about the selected theme and why you chose it.
      • Overview of your project.
      • Project demonstration.
  13. You can submit only one project per entry. You can edit, update, or change your project as many times as you want before the deadline. You can also choose more than one project category to make your project.

  14. The jury evaluation process will be disclosed soon. 
  15. The outcome of the Competition shall be final and binding any challenge to the same shall be not entertained.
  16. Details of the Prize to be awarded to the Winners of the Competition:

    2. Cash and Coupons
    3. Trophies and Medals
    4. Mentorship Opportunities
  17. AR reserves the right to amend/replace the Prize(s) to be distributed to the Winners. No objection in this regard shall be entertained.
  18. AR reserves the right to postpone the Competition or withdraw or amend the terms and conditions of the Competition as it may deem necessary or fit.
  19. The prizes for the Competition will be given to the winner as set out in the Terms. The winner must accept his/her prize in that form. Prizes are non-negotiable, non-transferable, non-refundable, and not exchangeable for cash credit or kind, either in part or in full except at the sole and absolute discretion of the AR.
  20. AR reserves the right in its sole and absolute discretion to deal with any unclaimed prizes in any manner.
  21. AR shall not be liable in any way for any failure or breach by any party in connection with the Competition, prize, or prizes and accepts no responsibility for any loss suffered by a participant arising from the Competition, prize, or prizes.
  22. Any winner of the Competition may, at no cost to AR, be requested to participate in public relations events tied to the campaign to generate press coverage of the Competition. This may include, but not be limited to, quotes given for inclusion in press releases and press conferences, interviews, etc.
  23. By participating in the Competition, the Participant allows:
    1. the usage of their name, quotes, and/or likeness, without compensation, for AR promotional and marketing purposes; and
    2. to use their answers to the Competition questions, without compensation, for AR’s promotional and marketing purposes.
  24. Any attempt by a Participant to deliberately damage or undermine the legitimate operation of the Competition is a violation of Criminal and Civil Laws and should such an attempt be made, AR reserves its right to seek damages from any such Participant to the fullest extent as permitted by law.
  25. Any content created by any Participant during the Program or the Competition shall be the sole proprietary of AR. The Participant hereby agrees to assist in the transfer of all/any right that accrues to the Participant due to the creation of the content under the applicable law. Such transfer shall be without any compensation and/or future royalties (if any).
  26. All entries will be treated as the property of AR only and can be used by AR (or any third party authorized by AR in this regard) for any promotional and/or commercial activity & the participants/winners waive all rights of whatsoever nature in the said entries in favor of AR by participating in the Competition.
  27. Winners may be required by AR to participate in a photo, video, and/or film session and acknowledge that AR has the absolute and exclusive right to use such photos, videos, and/or films in any medium and in any reasonable manner it may deem fit for publicity without any consideration or payment of similar nature to such participants/winners.
  28. AR in its absolute discretion may publicize, broadcast, or otherwise disclose a participant’s/winner’s name, character, likeness, statements, or any recording of their voice in advertising or promotional activities concerning this Competition, or generally. AR may promote or advertise that a winner has won the Competition.
  29. AR, and/or its representatives shall not be liable to any person or entity for any direct, indirect, incidental, special, punitive, or consequential damages, including loss of profits, incurred by the winner or any third party, whether in connection with this Competition or for breach of any warranty or in tort.
  30. Participant/User agrees to indemnify AR, its agents, employees, representatives, associates, affiliates, parent and subsidiary companies against any and all claims, losses, costs, damages, liability, and expenses arising out of the Participant’s breach of any of the T&C or arising out of or in connection with their entries to the Competition.
  31. Participant, by entering the Competition, expressly releases AR from any claim, action, or demand arising out of or in connection with the Competition or their prize, if any.
  32. AR shall not assume any responsibility for incorrect or inaccurate capture of any Participant’s information. This will include but not limited to technical malfunctions, human or technical error, seeding or printing errors, lost or delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof.
  33. The laws of India shall govern these T&C. The courts of Ahmedabad will have exclusive jurisdiction in case of any dispute arising under the Terms and Conditions herein.
  34. Any provision of the T&C that is prohibited or unenforceable in any jurisdiction shall be ineffective as to that jurisdiction to the extent of that prohibition or unenforceability. That does not affect the validity or enforceability of that provision in any other jurisdiction nor invalidate the remaining provisions of the T&C.
  35. AR shall not be responsible for any loss or damage suffered by the participants while participating in the Competition.
  36. Failure by AR to enforce any of these Terms and Conditions in any instance(s) shall not give rise to any claim by any person.
  37. This Competition is being created as a promotional activity for AR and all goodwill, copyright, moral rights or other intellectual rights associated thereto shall vest exclusively with AR.
  38. The Competition is valid subject to the winner complying with all T&C and/or formalities as required by AR. Any failure on the part of the Participant to comply with any specified term, condition, and/or formality shall render the Participant liable for disqualification at the sole discretion of AR.
  39. Payments: The Platform is a paid service and the payments made by the User registering as a Participant shall be according to the plans opted by the participant through the Platform. All payments by Users shall be through the payment mechanism put in place by AR. Users shall be various options to choose from and proceed with the payment for the enrollment/participation via payment mechanisms including but not limited to Card Payment facilities, Online Bank Transfer, and Wallet Payment. It is hereby clarified that the payment gateway mechanisms are governed by the terms and conditions of the third-party providers as listed on the Platform and the User agrees to be bound by those terms. Valid Credit / Debit/ Cash Card/ online bank transfers and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms agreed to between the Users and the respective issuing bank and payment instrument issuing company. AR shall not be liable for any unauthorized use, fraud, payment refunds, lost amount, etc. in the transaction.
  40. User Communication: Participants hereby explicitly consent to receive communication from AR or a representative by email, telephone, WhatsApp, or text message for the purposes of providing alerts and information about our services.
  41. User Content: The information, photo, image, chat communication, text, software, data, music, sound, graphics, messages, videos, or other materials transmitted, uploaded, posted, emailed, or otherwise made available to AR (“User Content“), are entirely user’s/participant’s responsibility and AR will not be held responsible, in any manner whatsoever, in connection to the User Content. The User/Participant agrees not to encourage or assist or engage others as well as himself/herself in transmitting, hosting, displaying, uploading, modifying, publishing transmitting, updating, or sharing any information that belongs to another person and to which the user does not have any right to. AR shall in no way be held responsible for examining or evaluating User Content, nor does it assume any responsibility or liability for the User Content. AR does not endorse or control the User Content transmitted or posted on the Site by the User and therefore, accuracy, integrity, or quality of User Content is not guaranteed by AR. User/Participant understands that by using the Site, he/she may be exposed to User Content that is offensive, indecent, or objectionable to him/her. Under no circumstances will AR be liable in any way for any User Content, including without limitation, for any errors or omissions in any User Content, or for any loss or damage of any kind incurred by him/her as a result of the use of any User Content transmitted, uploaded, posted, emailed or otherwise made available via the Site. Users hereby waive all rights to any claims against AR for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with User Content.
  42. Account: User/Participant will be responsible for maintaining the confidentiality of his/her account, and password, and restricting access to his/her computer, and he/she hereby accepts responsibility for all activities that occur under his/her account and password. Participants acknowledge that the information he/she provides, in any manner whatsoever, is not confidential or proprietary and does not infringe any rights of any third party.
    If a User is accessing, browsing, and using the Site on someone else’s behalf; he/she represents that he/she has the authority to bind that person to all the terms and conditions herein. In the event that the person refuses to be bound as the principal to the Terms of Use, he/she agrees to accept liability for any harm caused by any wrongful use of the Site resulting from such access or use of the Site.
    If a User knows or has reasons to believe that the security of his/her account has been breached, he/she should contact AR immediately at the Contact Information provided below. If AR finds a breach or suspects a breach of the security of a User’s /Participant’s account, AR may require the User to change the password or suspend the account without any liability to AR.
    AR reserves the right to refuse service and/or terminate accounts without prior notice if these Terms of Use are violated or if AR decides, in AR’s sole discretion. A User/Participant is solely responsible for all content that he/she uploads, posts, emails, or otherwise transmits via the Site. The information provided to AR shall be maintained by AR in accordance with AR’s Privacy Policy.
  43. AR reserves the right, in its sole and absolute discretion, to amend or vary any of these Terms & Conditions at any time without prior notice or intimation.
  44. By enrolling in the Program and/or participating in the Competition hereby acknowledges and agrees to abide by the Privacy Policy, Cookie Policy, and other policies as may be amended from time to time.

     

    Participants’ Agreement and Guidelines

    Honest Communication

    1. Comply with this Code of Civility 
    2. Be accurate (where they state facts)
    3. Be genuinely held (where they state opinions) 
    4. Be in compliance with applicable law in any country from which they are posted
    5. Respect Oneself and Others 

    We require that all Codevaour participants treat other people with respect. Any use of Communication Services (see the Code of Civility) to threaten, harass, stalk, or abuse others using these services is unacceptable and is strictly forbidden. All contributions are expected to: We reserve the right to remove content that advocates or encourages expressions of violence, bullying, general cruelty, bigotry, racism, illegal activity, hatred, or profanity. This includes content that is deemed inappropriate, offensive, or that violates guidelines in the Terms of Service or the Code of Civility. Falsely impersonating a Codeavour employee, agent, manager, host, or any other person other than oneself is forbidden. 

    Code of Civility

    As part of the commitment to making Codeavour and its related social media channels a great place to meet and interact with others who have a passion and commitment to science, technology, engineering, math, innovation, and entrepreneurship, you agree to abide by this Code of Civility. By participating on the Site and social media community, you give your commitment to abide by this Code when contributing to all Codeavour resources and programs, including, but not limited to, profiles, team pages, chats, posts and comments, emails, social media sources, etc. (“Communication Services”), and to help create a positive experience for all the community’s users.  We reserve the right in our sole discretion to eject or ban any user from participating in the Codeavour, the Site, or social media community who behaves in a manner deemed inappropriate or offensive, or who violates the guidelines of this Code of Civility. Codeavour and its partners and service providers are not responsible for any user-created content or other activities. 

    Protect Your Privacy

    We caution you against sharing unnecessary personally identifiable information during the Zoom challenge (such as home address or personal contact information), which may be inadvertently obtained by others or, in rare instances, used for illegal or harmful purposes. Talk to your coach, parent, or the Codeavour staff if you have a question or concern. 

    Protecting Your Intellectual Property

    It is the sole responsibility of the creator(s) of their innovation to determine whether their innovation requires protection, and what type of protection it may require. It is the sole responsibility of the creator to contact the appropriate legal professionals to secure any or all protection they deem necessary. Anytime you decide to share your idea or innovation, if you have a scientific discovery or invention that could lead to a Patent or any other intellectual property protection, it is best to check your country’s patent law before publicly sharing your idea. It is important to understand the intellectual property laws in your country if you have any plans to bring your product to market in the future. When presenting, be cautious about sharing the specific details of what you made and focus on sharing the general operation and benefits of your product. 

    Non-discrimination Policy

    The Codeavour continuously addresses issues of diversity and multiculturalism and is committed to engaging in actions that create inclusive communities, increase diversity, and eliminate discrimination. The Codeavour prohibits discrimination based on race, color, ethnicity, religion, sex, national origin, age, ancestry, disability, status as a veteran, sexual orientation, marital status, parental status, and gender identity or expression in all of its programs and activities. 

    Release Agreement

    By registering your child, you grant permission for your child to take part in the Codeavour and verify agreement with the following Codeavour photography/filming release: Without expectation of compensation or other remuneration of any kind, now or in the future, on behalf of my registered student, I as guardian do hereby give consent, permission, and authorization to Codeavour, including its parent, affiliates, subsidiaries, successors, members, directors, officers, principals, partners, and agents, to use their name, image and likeness, including all rights, title, and interest therein, for Codeavour’s use in whatever form (digital, web-based, hard-print or otherwise) and for whatever purpose in perpetuity. Codeavour’s use includes, without limitation, any advertising, video footage, recording, publication, website, radio, digital media, print media, or other promotional marketing or media activities, as well as, all film, motion picture, and television rights (e.g., free television, pay television, basic cable, subscription, video-on-demand, pay-per-view, syndication, digital streaming, and all other methods of transmission delivery systems and formats). Both my registered child and I as their guardian, hereby further release Codeavour from any claims or disputes, including damages in any form, for libel, slander, right of publicity, invasion of right of privacy, trademark infringement, or false endorsement, breach of contract, or any other tortious claim or personal right associated with Codeavour’s use of said name, image and likeness, and further, hereby acknowledge that Codeavour shall have no obligation to use said name, image or likeness. This consent is given in perpetuity and does not require prior approval. By completing the online registration and paying the non-refundable registration fee, I hereby grant my child permission to participate in the Codeavour. I have been thoroughly informed of the rules and requirements of the Codeavour I understand and consent to my child being in virtual contact with Codeavour employees and volunteers to evaluate and advise my child’s project. I hereby release Codeavour and any of its officers, directors, employees, or sponsors, from responsibility and liability for any damage, injury or illness that my child may sustain as a result of or in any way connected to my child’s participation in the Codeavour and, further, waive any rights to assert any claims against Codeavour for any damages allegedly sustained as a result of my child’s participation in the Codeavour.

    Behaviour Agreement

    1. I understand and agree that my child’s behavior concerning their participation in the Codeavour is my responsibility. I will instruct my child in proper behavior and ensure that they respect and adhere to the Code of Conduct, which includes the Participant Community Guidelines and the following: 
    2. The content of my child’s project submission in the Codeavour shall be age-appropriate and non-discriminatory. 
    3. My child’s Codeavour project submission must be of a nature where it cannot cause harm to property, animals, my child or other children, and any other adults. 
    4. Plagiarism, defined as when an author attempts to pass off someone else’s work as their own, of any type and format, is strictly prohibited. 
    5. In the event of (a) behavior problem(s) regarding my child’s participation in the Codeavour failure to adhere to the Participant Community Guidelines, I understand that I will be contacted to correct any problem or issue. In the event a problem or issue cannot be corrected, I recognize my child will no longer be allowed to participate in the Codeavour for the remainder of the event year.
